Installing or using Upmark means you accept these terms, so the parts that matter are at the top.

Who you are agreeing with
Upmark is a product of Devaprime LLC, referred to below as we or us. Reach us at hello@devaprime.com.
What Upmark cannot promise
Upmark schedules alarms through Apple’s AlarmKit and records whether you completed a Wake Walk in time. It is a habit and accountability tool.
It cannot guarantee that you will wake up. An alarm depends on your phone being charged, switched on, within earshot, with its ringer up, and on iOS delivering the alert. Any of that can fail for reasons outside our control. Do not rely on Upmark alone where oversleeping would be dangerous or seriously costly.
Upmark is not a medical device or a sleep tracker. Nothing it shows is medical advice.
Every AlarmKit alert carries a stop button that iOS requires. Silencing an alarm is always possible. Upmark records the outcome, it does not enforce it.
What you need
- An iPhone running iOS 26 or later.
- Permission for alarms, notifications, and Motion and Fitness.
- To be at least thirteen, and old enough to hold an Apple Account where you live.
Membership and renewal
Upmark is sold as an auto renewing subscription through the App Store. Current plans and prices are shown in the app before you buy.
- A new membership normally starts with a free trial that converts to paid unless you cancel.
- It renews automatically unless cancelled at least twenty four hours before the period ends.
- Payment goes to your Apple Account. Manage or cancel in your Apple subscription settings. Deleting the app does not cancel anything.
- Cancelling stops the next renewal. Time already paid for is not refunded.
- Apple handles refunds under its own terms. We cannot issue them, but we will help you ask.
- Price changes apply to renewals after we tell you, and Apple confirms where its rules require.
Invite codes
Members can share a code that gives someone free time, and can earn free time when an invited person subscribes. Codes have no cash value and cannot be sold. We may cancel codes and withdraw granted time where a code is used to abuse the offer.
How you may use it
You agree not to:
- Reverse engineer, decompile or modify the app, except where the law says you may.
- Interfere with our services, or reach data belonging to other people.
- Fake step data to misreport a morning to a service we run.
- Use the app unlawfully, or in a way that breaks Apple’s App Store terms.
Your content
The lines you write and the voice notes you record stay on your device and remain yours. We claim no licence over them because we never receive them.
Our content
The app, its name and its design belong to us or our licensors. You get a personal, non transferable, revocable licence to use it on devices you own, on these terms and on Apple’s Licensed Application End User License Agreement, which applies alongside this page.
Ending the agreement
Cancel your subscription and delete the app whenever you like. We may suspend access if these terms are seriously or repeatedly broken, and we will say why unless the law stops us.
No warranty
Upmark is provided as it is, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose and non infringement. We do not warrant that the app will be uninterrupted, error free, or that any alarm will sound.
Limitation of liability
To the maximum extent the law allows, we are not liable for indirect, incidental, special or consequential damages, including anything arising from a missed alarm such as missed appointments, travel, work or income. Our total liability for any claim will not exceed what you paid us in the twelve months before it arose.
Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud. Consumers keep every right their local law gives them.
Apple
Apple is not a party to these terms and has no obligation to support the app. Apple and its subsidiaries are third party beneficiaries and may enforce these terms against you. Any claim that the app fails to conform to a warranty is ours to answer, not Apple’s.
Changes
We may update these terms. Material changes appear in the app before they take effect, and continuing to use Upmark means you accept them.
Governing law
These terms are governed by the laws of the jurisdiction in which Upmark is operated, and any dispute is for the competent courts of that jurisdiction. If you are a consumer elsewhere, you may also bring proceedings in your own country and its consumer protections still apply to you.
